Purpose

Council resolved to prepare Amendment No. 54 to City Planning Scheme No.2 (CPS2) at its Ordinary Council Meeting held on 9 December 2025.

Amendment No. 54 would allow 'Entertainment' ('Amusement Parlour' and 'Small Bar'), 'Business Services' and 'Education 2' as additional land use groups at 99 (Lot 10) Adelaide Terrace, East Perth.

The ‘Entertainment’ use group means ‘premises used for the purpose of amusement, entertainment or similar purposes and operated generally on a commercial basis including: amusement parlour, betting agency, cinema/theatre, club, function centre, nightclub, tavern.’

The term ‘Amusement parlour’ means ‘premises - (a) that are open to the public; (b) the predominant use of which are for amusement by means of amusement machines; and (c) that have at least three amusement machines operating within the premises during operating hours.’

The term ‘Small Bar’ means ‘premises - (a) used to sell liquor for consumption on the premises; and (b) that are the subject of a small bar licence under the Liquor Control Act 1988.’ Under the Liquor Control Act, a small bar is limited to a maximum of 120 people.

The 'Business Services' use group means ‘premises used for the provision of services which are predominantly administrative in nature and which – (a) are dependent on direct access to the public; and (b) generally have a retail shop front, and includes a bank or building society, post office, real estate agency and travel agency.’

The 'Education 2' use group means: ‘Educational facility – upper’ premises used for – (a) a secondary school; or (b) post-secondary education, including a tertiary institution, business college, employment training centre or academy’.

To integrate the additional uses into the existing planning framework, the Adelaide Precinct Plan No. 13 Policy is also proposed to be amended to require an application for development approval for the land uses 'Amusement Parlour' and 'Small Bar' to be advertised for public comment (as detailed in Attachment C.
